The Workers' Compensation Appeals Board (WCAB) granted CIGA's petition for reconsideration, rescinding the original findings and remanding the case. The WCAB found that Dr. Charles' medical reports should be admitted for the pre-January 1, 2005 injury claim (ADJ2055470) as the procedural rules for exclusion did not apply. However, the WCAB affirmed the prior denial of cumulative injury for the later claim (ADJ8917668) due to CIGA's stipulation not to seek contribution and the lack of reconsideration from other parties. Finally, the WCAB admonished defense counsel for unprofessional language and referencing excluded evidence.
