SANDY SAVARD vs. PAN PACIFIC PLUMBING MECHANICAL, TRAVELERS

The Workers' Compensation Appeals Board granted defendant's Petition for Reconsideration, rescinded the prior Findings, Award and Order, and returned the case to the trial level for further proceedings. The Board found that the original decision did not adequately address the statute of limitations defense raised by the defendant and the applicant's arguments regarding tolling. Due to potential due process concerns regarding incomplete analysis of tolling, the Board vacated the decision to allow parties a full opportunity to be heard on these issues. The applicant's Petition for Reconsideration was consequently denied as they are no longer aggrieved by the rescinded F&O.
