Ramon Martinez vs. Eugene Frost Trucking and Sales, Inc., State Compensation Insurance Fund

Defendant State Compensation Insurance Fund sought reconsideration of the Appeals Board's prior decision which found a contested claim existed when a lien claimant performed services, and that those services were reasonable and necessary. The defendant contended there was no contested claim and that the lien claims should be dismissed. The Appeals Board reviewed the matter, including the applicant's initial application for adjudication and the subsequent resolution via Compromise and Release. Finding that a contested claim did exist and that the discovery subpoenas were relevant, the Appeals Board denied the defendant's petition for reconsideration, upholding its prior decision.
