The Workers' Compensation Appeals Board (WCAB) dismissed the Petition for Reconsideration because the WCJ's decision to take the case off calendar was not a final order. The WCAB granted the Petition for Removal, rescinded the WCJ's decision, and remanded the case for further proceedings. This action will allow the WCJ to determine if an arbitration agreement exists and clarify the issues for arbitration. The parties can also raise the issue of sanctions during these further proceedings.
