(VNO 0490685) is a case in which defendant QTC Medical Group, Inc. and State Compensation Insurance Fund sought reconsideration of an Order issued by the workers’ compensation administrative law judge (WCJ) on May 4, 2009, wherein the WCJ vacated the July 24, 2007 Order of Dismissal for Lack of Prosecution. The WCAB granted reconsideration, rescinded the May 4, 2009 Order, and substituted an Order dismissing the case. The WCAB found that the July 24, 2007 Order of Dismissal for Lack of Prosecution was a final order affecting applicant’s substantive rights, and that the WCJ did not have authority to vacate the dismissal after the 60 days provided by statute.
