Rostiam Vartanian, vs. Miracle Rooter Plumbing; State Compensation Insurance Fund,
is a case in which Rostiam Vartanian, an applicant, sought reconsideration of an October 7, 2009 Order Approving Compromise and Release (OACR) issued by a workers’ compensation administrative law judge (WCJ). The WCJ dismissed the petition for reconsideration due to the fact that it did not comply with the requirements set by law and regulation for a petition for reconsideration. The WCJ also noted that the applicant could seek review of the OACR through a petition to reopen for good cause pursuant to Labor Code section 5803.
