Nagwa Tanious, vs. Baskin Robbins; Preferred Employers Insurance Company,

In this case, Nagwa Tanious, an employee of Baskin Robbins, filed a petition to reopen for new and further disability after sustaining an industrial injury to her right upper extremity, hand, wrist and elbow. The defendant, Preferred Employers Insurance Company, filed a Declaration of Readiness to Proceed and the case was scheduled for a Mandatory Settlement Conference. The applicant did not object to the Declaration of Readiness to Proceed and did not schedule the cross-examination of the Agreed Medical Evaluator prior to the MSC. The Workers’ Compensation Appeals Board granted the defendant’s petition for removal, closed discovery, and returned the case to the trial level to be set for trial.
