In this case, the City of Sacramento sought reconsideration of a workers’ compensation administrative law judge’s (WCJ) finding that applicant William Ross sustained new and further disability causing an additional period of temporary disability from November 17, 2004 to June 23, 2005, and 63% permanent disability, following his November 3, 2004 award for his three cumulative trauma injuries. The WCJ found that Ross was entitled to temporary disability benefits, but the City of Sacramento argued that Ross was not entitled to temporary disability benefits since he had retired and had no intent to seek further employment, and interrupted his participation in vocational rehabilitation for reasons unrelated to his disability.
