(SJO 0267873)In this case, John Vlcek, an employee of The Home Depot, was granted reconsideration of the Findings and Award of September 26, 2008, to further study the issues in the case. The case was returned to the trial level to allow the WCJ and parties an opportunity to consider and apply the Appeals Board’s recent en banc decisions in Ogilvie v. City and County of San Francisco and Almaraz v. Environmental Recovery Services.
