Skelly (WCJ Skelly). In addition, lien claimants seek removal of two interim orders issued by WCJ Skelly on November 14, 2019, wherein the WCJ denied lien claimants’ “Petition Regarding Jurisdiction to Determine Whether Labor Code section 139.21 Applies to Their Lien” (Jurisdiction Removal and Jurisdiction Order); and, wherein the WCJ denied the joint petition of lien claimants and the Department of Industrial Relations Anti-Fraud Unit to vacate the trial date (Vacate Removal and Vacate Order).            Lien claimants contend that WCJ Skelly must be disqualified because he has “formed or expressed an unqualified opinion or belief as to the merits of the action” (Code Civ. Proc., § 641(f)), and/or that he has demonstrated “[t]he existence of a state of mind … evincing enmity against or bias toward either party” (Code Civ. Proc., § 641(g)).
