In this case, Un Chu Ko, an intermediate typist clerk with the County of Los Angeles Department of Child Support Services, filed a Petition for Reconsideration alleging that she sustained injury arising out of and in the course of employment to her psychological system and that her injuries were not barred pursuant to Labor Code § 3208.3(h). The Petition for Reconsideration was denied by the Workers' Compensation Appeals Board based on their review of the record and the great weight given to the Workers' Compensation Administrative Law Judge's finding on credibility. The WCJ found that the Applicant's misperception of discrimination and harassment did not constitute actual events of employment and that the actions taken by the Defendant were appropriate given the Applicant's behavior
