ADJ4176866 (AHM 0093466)ADJ125605 (AHM 0093469)ADJ1808207 (AHM 0294929)OPINION AND ORDER GRANTING PETITION FOR RECONSIDERATION AND DECISION AFTER RECONSIDERATION Applicant seeks reconsideration of the Findings, Award and Orders, issued December 30, 2008, wherein the workers’ compensation administrative law judge (WCJ) found that applicant sustained a cumulative industrial injury, from October 6, 1994 to October 6, 1995, to his “spine, high blood pressure, hypertension, hypertensive heart disease, and psyche” while employed as a structural assembler. The WCJ also found that applicant became permanent and stationary on January 16, 2004 and “again on March 28, 2005 after an additional period of temporary disability from February 7, 2005 to March 28, 2005.” The WCJ awarded 46-1/2 percent permanent disability “in the sum total of $39,606.00 after apportionment.” Finally, the WCJ ordered “that the request for reimbursement to the Law Offices of Baziak & Steevens for the testimony of the expert, Jeanine Metildi, is denied.” Applicant contends that the WCJ erred: (1) by awarding insufficient permanent disability benefits arguing that the doctrines set forth in Wilkinson v. WCAB (1977) 19 Cal.3d 491, requires an award of additional permanent disability benefits; (2) by failing to find that applicant sustained a compensable industrial injury to his right knee arguing that this injury “was an admitted part of the body for the first continuance trauma date of injury” as noted in the “Minutes of Hearing of August 28, 2008 at page 2, lines 11-16”; (3) by failing to award applicant’s
