By the F&O, the WCJ denied defendant’s Petition for Dismissal of applicant’s specific injury claim (Case No. ADJ10658899). Defendant contends that the F&O will cause irreparable harm because defendant will need to re-litigate a claim that was purportedly already resolved by Compromise and Release in Case No. ADJ9758271. We did not receive an answer from applicant. The WCJ filed a Report and Recommendation on Petition for Removal/Reconsideration (Report) recommending that reconsideration be denied. We have considered the allegations of defendant’s Petition for Removal and In the Alternative Petition for Reconsideration and the contents of the WCJ’s Report with respect thereto. Based on our review of the record, and for the reasons stated in the WCJ’s Report, and as discussed below, we will deny defendant’s Petition for Reconsideration.FACTUAL BACKGROUND Applicant claims injury to her shoulders, neck, hand, head, arm and back on April 10, 2015 while employed as a caregiver for the Department of Social Services (Case No. ADJ10658899). , Applicant also claimed injury to her arm, elbow, shoulder, musculo-skeletal system and nervous system from August 6, 2011 through June 15, 2014 while employed in the same position (Case No. ADJ9758271).
