Applicant,vs.CHILDRENS HOSPITAL of ORANGE COUNTY, permissibly self-insured, administered by TRISTAR RISK MANAGEMENT, Defendants.Case No. ADJ1084f l32OPINION AND ORDER GRANTING PETITION FOR RECONSIDERATION AND DECISION AFTER RECONSIDERATION Applicant seeks reconsideration of the Findings and Award (F&A) issued by the workers’ compensation administrative law judge (WCJ) on October 28, 2019, wherein the WCJ found in pertinent part that the appropriate occupational group number for applicant’s employment as a child life specialist was 2141 and that the injury caused 24% permanent disability, after apportionment. Applicant contends that defendant did not meet its burden of proof regarding apportionment because the reports from orthopedic qualified medical examiner (QME) Wayne Cheng, M.D., are not substantial evidence as to the issue of apportionment. We received a Report and Recommendation on Petition for Reconsideration (Report) from the WCJ recommending the Petition be denied. We received an Answer from defendant. We have considered the allegations in the Petition and the Answer and the contents of the Report. Based upon our review of the record, and for the reasons set forth below, we will grant reconsideration and affirm the F&A except that we will amend Finding #1 to find that 214 is the proper occupational group number, we will amend Finding #6 to find that the injury caused 44% permanent partial disability, 1 We note that Finding #1 sates that the occupational group number is 340.
