ADJ4596412 (VNO 0384173)OPINION AND ORDER GRANTING PETITION FOR RECONSIDERATION AND DECISION AFTER RECONSIDERATION Lien claimant, Comprehensive Therapeutics (lien claimant), through its representative, Optimum Lien Services, seeks reconsideration of the Findings and Award/Order issued by a workers’ compensation administrative law judge (WCJ) on June 8, 2009, wherein the WCJ found lien claimant is entitled to $4,492.97 on its lien balance of $39,159.77 for physical therapy. The WCJ also found that lien claimant had already been paid $4,831.80, and therefore ordered it to reimburse defendant the $739.23 overpayment. The WCJ further found that lien claimant had been paid an additional $30,000.00, and ordered it to reimburse that amount to defendant. In the Award/Order, the WCJ ordered lien claimant to reimburse defendant the sum of $34,831.80. (This appears to be a clerical error in that in his Report and Recommendation the WCJ states he ordered lien claimant to reimburse $30,739.23.) In the underlying matter, the WCJ previously found that applicant sustained industrial injury to her neck, back, and psyche, while employed as a teacher assistant on December 15, 1998, causing 100% permanent disability and a need for further medical treatment. Lien claimant contends that the WCJ erred in applying the wrong values to arrive at the number of allowable pool therapy sessions and the amount payable to it. Lien claimant also , contends the WCJ abused his discretion in ordering it to reimburse $34,831.80 to defendant, arguing that the payments it received were for services that defendant knew were preauthorized and
