FRANCESCA HANNAN On July 13, 2012, we granted the Petition for Reconsideration of lien claimant, California Pharmacy Management (CPM), to further study the factual and legal issues in this case. This is our Opinion and Decision After Reconsideration. CPM sought reconsideration of the Findings & Order (F&O) issued on April 18, 2012 by a workers’ compensation administrative law judge (WCJ). The WCJ found that CPM did not meet the burden of proof on its lien and disallowed the lien. In its Petition for Reconsideration, CPM contended in pertinent part that it was denied due process because the WCJ did not allow its witness(es) to testify at trial on March 14, 2012. CPM’s hearing representative Presley Surujnarain (Surujnarain), of Pres Lien Services, Inc., appeared on behalf of CPM at the trial. Attorney M. Francesca Hannan (Hannan) filed the Petition for Reconsideration on behalf of CPM. We received an answer from defendant. We received a Report and Recommendation on Petition for Reconsideration (Report) from the WCJ in response to CPM’s Petition for Reconsideration which recommended that the Petition be denied. Surujnarain filed supplemental responses on August 13, 2012 and on September 7, 2012. Hannan filed supplemental responses on July 30, 2012 and on September 10, 2012. , We have reviewed the record and considered the Report, the Petition for Reconsideration, the responses, and the answer, and we now issue our decision after reconsideration.
