(2016) 6 Cal.App.Sth 1128 [81 Cal,Comp.Cases 1127], the Court of Appeal, Third Appellate District annulled the earlier February 18, 2016 Opinion And Decision After Reconsideration (Decision) of the Workers’ Compensation Appeals Board, which in a split decision reversed the August 6, 2015 Findings Of Fact And Order of the workers’ compensation administrative law judge (WCJ), who found in pertinent part that disability pension advances paid under Labor Code section 4850.4 “constitute ‘compensation’ pursuant” to Labor Code section 3207, and that the penalty provisions of Labor Code section 5814 apply when there is unreasonable delay or denial in payment of those advances.
