JOHN’S PETITIONFOR RECONSIDERATION AND DECISION AFTER RECONSIDERATION Defendants Kaiser Permanente Medical Care Program (Kaiser) and St. John’s Health Center (St. John’s) each petitioned for reconsideration of the February 19, 2009 Findings and Order of the workers’ compensation administrative law judge (WCJ), who found that the medical reports of appointed examiner William Mouradian,, M.D. “do not constitute substantial evidence,” that the July 14, 2008 medical report of the parties’ Agreed Medical Examiner Philip Sobol, M. D., “does constitute substantial evidence,” and based upon those findings “reinstated” his earlier 19 January 11, 2005 Amended Findings, Award and Order, wherein he found, in pertinent part, that as a result of the admitted industrial injuries to her several body parts while employed by Kaiser as a surgery scheduler on February 16, 1999, and during the period from December 17, 1979 through July 7, 1999, applicant incurred 100% permanent disability and need for future medical treatment, and that there was “no legal basis for apportionment” of applicant’s permanent disability to her employment by St. John’s.1 1The WCJ’s February 19, 2009 decision erroneously refers to reinstatement of his earlier December 17, 2004 Findings and Award.
