This is our Opinion and Decision after Reconsideration. Applicant seeks reconsideration of the September 9, 2020 Joint Findings and Order (F&O) issued by the workers’ compensation administrative law judge (WCJ). As relevant herein, the WCJ found that applicant, while employed as a registered nurse by Veterans Home of California (Veterans Home),1 claims to have sustained industrial injury on June 13, 2013 (ADJ9429528), and from May 1, 2013, to June 18, 2013 (ADJ9128602); and that applicant and Veterans Home did not reach an agreement to use Dr. Adel Mostafavi as their Agreed Medical Examiner (AME) in ADJ9429528 or ADJ9128602. Applicant contends that she relied on Veterans Home’s “communications and letters” to Dr. Mostafavi that he would be the AME in applicant’s cases against it. Thus, applicant argues that the contract principle of promissory estoppel should bind Veterans Home to its promise. We have not received an answer from defendant. The WCJ prepared a Report and Recommendation on Petition for Reconsideration (Report), recommending that the Petition be denied. 1 We note that Veterans Home has also been spelled Veteran’s Home in the record.
