The WCJ found that applicant was entitled to permanent disability in the amount of $114,655.00 payable at $230.00 per week, and a life pension at the rate of $69.59. Defendant contends that the WCJ erred in awarding $114, 655.00 in permanent disability and a life pension of $69.58 per week, arguing that the correct dollar value for 70% permanent disability is $98,095.00 and the correct life pension amount is $38.65. Defendant also contends that the WCJ erred in failing to apportion applicant’s permanent disability in accordance with the opinion of the Agreed Medical Evaluator (AME). We have considered the Petition for Reconsideration, and we have reviewed the record in this matter. We have not received an Answer from applicant. The WCJ has retired and has not prepared a Report and Recommendation on Petition for Reconsideration. For the reasons discussed below, we will grant reconsideration and amend the November 27, 2012 Findings and Award to find that applicant sustained 78% permanent disability.
