Spears Manufacturing Co.; Zurich Insurance Company Modesto Vargas WORKERS’ COMPENSATION APPEALS BOARDSTATE OF CALIFORNIAMODESTO VARGAS, Applicant,vs.SPEARS MANUFACTURING CO.; ZURICHINSURANCE COMPANY, Defendants.Case No. ADJ4440540 (LAO 0862447)OPINION AND ORDER GRANTING RECONSIDERATION AND NOTICE OF INTENTION TO IMPOSE SANCTIONS Lien claimants, Bahar Gharib Danesh Chiropractic, Pain Free Diagnostics, and Pain Relief Health Center, through their representatives Qualified Billing and Collections, LLC (QBC) and Diego Plasencia, seek reconsideration of three Orders Dismissing Liens issued on February 20, 2013, wherein the workers’ compensation administrative law judge (WCJ) dismissed their liens. In each of the Orders, the WCJ noted that Notices of Intention to Dismiss Lien had been served on November 1, 2012, and that no objections thereto were submitted. Lien claimants contend that the WCJ erred in dismissing their liens, because lien claimants did not receive the November 1, 2012 Notices of Intention to Dismiss Liens. Lien claimants also contend, citing Appeals Board Rule 10562, that the WCJ should not be permitted to dismiss their liens for failure to appear at a lien conference. (Cal. Code Regs., tit. 8, § 10562.) We have reviewed defendant’s Answer. The WCJ prepared a Report and Recommendation on Petition for Reconsideration (Report), recommending that the Petition be denied. We have considered the Petition for Reconsideration, the Answer, and the contents of the Report, and we have reviewed the record in this matter. For the reasons discussed below, we will grant lien claimants’ Petition for Reconsideration (Petition) and issue a notice of intention to order sanctions of up , to $2,500.00 against lien claimants Bahar Gharib Danesh Chiropractic, Pain Free Diagnostics, and Pain Relief Health Center and their representatives, Qualified Billing and Collections, LLC and Diego S.
