Defendant contends that the Appeals Board erred in finding that the applicant sustained an industrial injury and that industrial injury caused a need for medical treatment including a partial amputation of his right leg, arguing that the decision is not based on substantial medical evidence. Defendant contends that if the record requires further development, the parties should return to the agreed medical evaluator (AME), Dr. Green. Defendant further contends that the Appeals Board erred in failing to rely on credibility determinations made by the WCJ. Defendant also contends that the applicant is barred from recovery by the defenses of first aid and statute of limitations. Finally, 1 Commissioner Alfonso J. Moresi signed the February 21, 2014 Opinion and Decision After Reconsideration, but he is no longer a member of the Appeals Board, and a new panel member was assigned in his place. , defendant requests that the case be returned to the same WCJ who initially tried the case.
