Marriott International; Marriott Claims Services Maria Vasquez WORKERS’ COMPENSATION APPEALS BOARDSTATE OF CALIFORNIAMARIA VASQUEZ, Applicant,vs.MARRIOTT INTERNATIONAL; MARRIOTTCLAIMS SERVICES, Defendants.Case No. ADJ2976653 (SDO 0363236)OPINION AND ORDER GRANTING PETITION FOR RECONSIDERATION AND DECISION AFTER RECONSIDERATION            Defendant Marriott International/Marriott Claims Services (defendant) seeks reconsideration of the Findings and Order (F&O) issued by a workers’ compensation administrative law judge (WCJ) on December 21, 2012.1 In that F&O, the WCJ found in pertinent part that defendant failed to sustain its burden of proof that it had a valid Medical Provider Network (MPN), failed to sustain its burden of proof of timely and proper notice to applicant Maria Vasquez of the MPN, and failed to sustain its burden of proof that lien claimants Alfonso Rodriguez Juanengo, D.C., and T. Eric Yokoo, M.D., were not medical practitioners within the MPN. In pertinent part, he ordered defendant to pay the liens of lien claimants Employment Development Department (EDD), Dr. Juanengo, California Medical Arts (Dr. Yokoo), Joyce Altman Interpreters, and ASAP Family Therapy (Ted Tribble, Psy.D.).            Defendant contends that lien claimants did not sustain their burden of proof that their liens were valid or reasonable; that the opinions of the Agreed Medical Evaluator (AME) and the MPN physician did not support that the treatment was necessary; that defendant met its burden that it gave notice of its MPN and lien claimants did not demonstrate that a lack of notice resulted in a neglect or refusal to provide treatment; and, that the WCJ improperly excluded its evidence. 1 Defendant’s attorney is reminded of Rule 10232, subdivision (4), which requires that all non-form legal pleadings contain a heading with the filing attorney’s name and California State Bar membership.
