ADJ4539382 (POM 0268767)ADJ703067 (POM 0273418)OPINION AND DECISION AFTER RECONSIDERATION On September 10, 2009, the Workers’ Compensation Appeals Board granted State Compensation Insurance Fund’s (Defendant SCIF) petition for reconsideration of the decision filed on June 16, 2009 in order to further study the factual and legal issues in this case. This is our decision after reconsideration. Defendant SCIF sought reconsideration of the Order issued on June 16, 2009, wherein an Arbitrator found that California Insurance Guaranty Association for Superior National Insurance Company, in liquidation, administered by Broadspire (CIGA) is entitled to reimbursement by Defendant SCIF in the amount of $121,773.60 for various medical and other related expenses paid on behalf of applicant, Maria Valdez. The Arbitrator’s Order requires Defendant SCIF to reimburse CIGA in the amount of $121,773.60. Defendant SCIF contends that the Arbitrator erred in ordering it to reimburse CIGA S121,773.60 because CIGA did not meet its evidentiary burden of establishing the reasonableness and necessity of payments it made on applicant’s behalf in that amount.
