The cancellation of the deposition took place on September 8, 2017 at defense counsel’s request, due to a family emergency, and the deposition has been re-scheduled for December 1, 2017 in the presence of David Pollak, the WCJ currently responsible for completing discovery in this matter. 1            In essence, it appears that applicant alleges he is being denied an opportunity to cross-examine Dr. Gilbert during the doctor’s deposition.            Defendant filed a brief response.            A Report and Recommendation (“Report”) on applicant’s petition was submitted by WCJ Pollak.            Applicant also submitted letters dated October 30, 2017 and November 7, 2017, apparently in response either to defendant’s response or to the WCJ’s Report.
