Juan Monterroso v. McAllister’s Auto Body: Workers' Comp Case Summary

is a case involving Juan Monterroso, an automobile painter, who claimed to have sustained injury to his respiratory system, internal, neurological and psyche during the period July 25, 1983 through November 1, 1996. The Workers’ Compensation Administrative Law Judge issued a decision on April 30, 2007 to dismiss Pacific Compensation/CIGA and Reliance Insurance Co/CIGA. Monterroso filed an untimely and verified request for Reconsideration, which was denied. The medical evidence showed that Monterroso’s symptoms were more consistent with Alzheimer’s than a chemical encephalopathy, and that there was no period of injurious exposure.
