MEJIA, Applicant,vs.BARRETT BUSINESS SERVICE, Permissibly Self-Insured, Defendants.Case No. ADJ4563910 (FRE 0244909)ORDER DENYING RECONSIDERATION We have considered the allegations of the Petition for Reconsideration and the contents of the report of the workers’ compensation administrative law judge (WCJ) with respect thereto. Based on our review of the record, and for the reasons stated in said report which we adopt and incorporate, we will deny reconsideration. In addition, we note that WCAB Rule 10842(a) requires that “[e]very petition for reconsideration, shall fairly state all of the material evidence[,]” and that the failure to do so “may be a basis for denying the petition.” (Cal. Code Regs., tit. 8, § 10842.) We strongly admonish the petitioning lien claimant, Innovative Medical Management, for making what appear to be false representations in its petition for reconsideration. Further infractions may well result in sanctions under Labor Code section 5813.///////////////////// , For the foregoing reasons, IT IS ORDERED that said Petition for Reconsideration be, and it hereby is, DENIED.WORKERS’ COMPENSATION APPEALS BOARD________________________________________MARGUERITE SWEENEYI CONCUR,_______________________________________RONNIE G. Jose R. Mejia vs. Barrett Business Service, Permissibly Self-insured
is a case in which Jose R. Mejia, the applicant, is suing Barrett Business Service, a permissibly self-insured defendant. The Workers' Compensation Appeals Board denied the Petition for Reconsideration filed by lien claimant Innovative Medical Management. The Board noted that the petition failed to state all of the material evidence, which is a basis for denying the petition, and admonished Innovative for making false representations in the petition. The Board also noted that the lien claimant had failed to pay the activation fee for the lien conference, which is required by the new Labor Code regulations, and recommended that the Petition for Reconsideration be denied.
