ADJ1785113 (LAO 0805120)ADJ3046898 (LAO 0805121)ADJ918089 (LAO 0827742)OPINION AND DECISION AFTER RECONSIDERATION On November 4, 2011, we granted reconsideration of the Petition for Reconsideration filed by lien claimant Frontier Medical, Inc., (hereafter “Frontier”). Frontier sought reconsideration of the August 2, 2011 Joint Findings and Order Regarding Sanctions issued by the workers’ compensation administrative law judge (WCJ) ordering Frontier to pay $2,500.00 to the Workers’ Compensation Appeals Board and ordering AIG/Chartis1 to pay costs and attorney fees in the amount of $8,082.33 to the Law Offices of Robert Wheatley. We granted reconsideration in order to allow us time to further study the factual and legal issues in this case. We now issue our Opinion and Decision After Reconsideration. Previously, a May 23, 2006 Order Approving Compromise and Release in the amount of $58,080.00 settled applicant’s underlying claims of admitted injuries to his lower extremities, upper extremities, shoulders, psych, head, jaw, neck, face, eyes, chest, and spine while employed on December 6, 2001, on May 12 2003, and during the period from January 9, 2001 to May 12, 2002. Frontier’s unresolved $2,935.002 lien was heard at a lien conference on June 29, 2011 and was tried on 1 There appears to be a clerical error in the Order which identifies “AIG/Chartis” as the entity to pay costs and attorney fees. The WCJ should correct this clerical error when he issues his new decision.2 The June 29, 2011 Pre-Trial Conference Statement shows that Frontier’s lien totaled $5,595.00 less amounts paid of $2,660.00. , Frontier contends that the WCJ erred in ordering it to pay costs and sanctions in the amount of $10,582.33
