Case No. ADJ3184041 (VNO 0534760) OPINION AND ORDER GRANTING PETITION FOR REMOVAL AND DECISION AFTER REMOVAL Defendant has filed a timely, verified Petition for Removal, requesting that the Appeals Board rescind the Order dated October 15, 2012, wherein the workers’ compensation administrative law judge (WCJ) declined to sign an order dismissing the lien claims of Diogenes Anesthesia Group, Doc Central, and EDS Financial Services (LCs), stating: “Defendant indicated 3 lien claimants on one NOI (Notice of Intention to Dismiss Liens); each lien claimant is entitled to receive NOI for its own lien claim. Defendant bundled lien claimants in one NOI. Order dismissing not signed.” Defendant contends that all three lien claimants received notice that their liens were subject to dismissal; that none of them responded; that only Doc Central appeared at a lien conference on October 15, 2012, and did not allege good cause Why its lien should not be dismissed; that all three lien claimants have had notice and an opportunity to appear; and that the liens should be dismissed. None of the three lien claimants has filed an answer. Applicant settled his case by Compromise and Release approved on August 2, 2012. The case was set for lien conference on August 23, 2012. None of the LCs appeared. Upon defendant’s motion, the WCJ signed the NOI that all three LCs would be disallowed ten days from the service of the NOI unless good cause to the contrary was shown in writing within ten days. Defendant served the NOI on LCs on August 24, 2012. None of the LCs filed an objection. , On October 8, 2012, defendant filed a letter to the WCJ, noting that there had been no response to
