ADJ1753403 (SJO 0182086)ADJ4666018 (SJO 0182087)OPINION AND ORDER GRANTING RECONSIDERATION AND DECISION AFTER RECONSIDERATION Defendant seeks reconsideration of a workers’ compensation administrative law judge’s Joint Findings and Award of March 10, 2009, wherein the WCJ found that, while employed as a truck driver on February 5, 1996 (SJO 0182086) and during a cumulative period from November 1988 to February 5, 1996 (SJO 0182087), applicant sustained admitted industrial injury to his neck, low back, and right upper extremity. Additionally, the WCJ found that applicant sustained non-stipulated industrial injury to his left upper extremity in case SJO 0182087 (the cumulative injury case), but not in SJO 0182086. It was found that the applicant’s injuries combined to cause temporary disability from February 6, 1996 to September 13, 2000 and from October 27, 2000 to January 2, 2005, and permanent disability of 641/2% after apportionment to a prior award of permanent disability pursuant to Labor Code § 4664. In finding that applicant was temporarily disabled until January 2, 2005, the WCJ found that applicant was permanent and stationary on January 3, 2005, purportedly based on the medical reporting of applicant’s qualified medical evaluator, Nicole Chitnis, M.D. Defendant contends that the WCJ erred in (1) finding that applicant was temporarily disabled until January 2, 2005 and in (2) finding permanent disability of 641/%, arguing that the WCJ erred in finding 95% overall permanent disability before apportioning to the prior award of , permanent disability, and arguing that the WCJ should have also apportio
