ADJ9175507ADJ8986566ADJ8968970ADJ8953708(Redding District Office)OPINION AND ORDER GRANTING PETITION FOR RECONSIDERATION AND DECISION AFTER RECONSIDERATION Applicant seeks reconsideration of a workers’ compensation administrative law judge’s (WCJ) Findings and Order of August 3, 2017 in case ADJ 91755071, wherein it was found that applicant did not sustain industrial injury to her psyche while employed as a work force development coordinator during a cumulative period ending on August 13, 2013. In the decision, the WCJ found that “Defendant has successfully established a post-termination defense which bars the applicant’s claim,” and that “The Defendant has successfully established a good faith personnel action defense which also bars the applicant’s claim.” In the Opinion on Decision accompanying the Findings and Order, the WCJ wrote, “applicant has from time to time been addicted to a variety of substances,” and that a “variety of medical commentators have noted that she is schizophrenic and paranoid.” The WCJ ordered that the applicant take nothing by way of her workers’ compensation claim. Applicant contends that the WCJ erred in finding that she did not sustain industrial injury to psyche. Applicant argues that while the WCJ appears to have based his decision on applicant’s purported substance problems and schizophrenia and paranoia, there is no evidence of applicant’s substance abuse or schizophrenia in the record.
