JOAN LOVELL, WORKERS’ COMPENSATION APPEALS BOARDSTATE OF CALIFORNIAJOAN LOVELL, Applicant,vs.COUNTY OF LOS ANGELES, Permissibly Self-Insured, Adjusted By TRISTAR RISK MANAGEMENT, Defendant(s).Case No. ADJ297809 (MON 0235953)OPINION AND ORDER GRANTING PETITION FOR RECONSIDERATION AND DECISION AFTER RECONSIDERATION Lien claimant The 4600 Group for PacifiCare Indemnity (hereafter “lien claimant” or “petitioner”) seeks reconsideration of the July 15, 2009 Order issued by a workers’ compensation administrative law judge (WCJ) in which the WCJ denied lien claimant’s petition for penalty and interest pursuant to Labor Code section 4603.2.1 Lien claimant’s lien had previously been resolved by the parties’ stipulations and the WCJ’s March 4, 2009 Award. Lien claimant contends that the WCJ erred in finding that defendant was not liable for accrued interest on petitioner’s lien where lien claimant served its lien on March 16, 2001, and no payment was received until April 2009. Lien claimant argues that the billings in its lien should be increased by 15 percent, in addition to interest at seven percent per annum from the date the bills were due pursuant to section 4603.2, subdivision (b) (hereafter “section 4603.2(b)”). No Answer was found in FileNet in the Electronic Adjudication Management System (EAMS) or in the file forwarded to us.
