Case No. ADJ680824OPINION AND ORDER GRANTINGRECONSIDERATION AND DECISIONAFTER RECONSIDERATION            By timely, verified petition applicant seeks reconsideration of the decision issued by a workers’ compensation administrative law judge (WCJ) in this case on July 15, 2010. That decision found that applicant failed to meet his burden of proving that while allegedly employed on March 7, 2009, as a plumber by defendant he sustained an injury arising out of and occurring in the course of his employment to his lower back.            On August 31, 2010, the WCJ advised the Appeals Board that applicant and the Uninsured Employers Benefit Trust Fund (UEBTF) have reached a settlement of this case by way of a Compromise and Release. Therefore, as our decision after reconsideration, we will rescind the decision filed on July 15, 2010, and return this matter to the trial level. If the settlement is not approved by the workers’ compensation administrative law judge (WCJ) the original decision may be reinstated, and either party may timely seek reconsideration from the reinstated décision. ,  For the foregoing reasons, IT IS ORDERED, that reconsideration of the Findings and Order of July 15, 2010 is GRANTED and that as the Appeals Board’s Decision After Reconsideration, said decision is RESCINDED and this matter RETURNED to the trial level for review of the settlement and any further proceedings the workers’ compensation administrative law judge deems appropriate.WORKERS’ COMPENSATION APPEALS BOARD________________________________________JAMES C.
