ADJ2375135 (MON 0350920) MF(MON 0350919)(Los Angeles District Office) OPINION AND DECISION AFTER RECONSIDERATION We granted reconsideration to further study the factual and legal issues in this case.1 This is our Opinion and Decision After Reconsideration. Defendant seeks reconsideration of the Findings and Order (F&O) issued by a workers’ compensation administrative law judge (WCJ) on May 22, 2015.2 The WCJ found that there was no utilization review (UR) and applicant is entitled to home health care services based on the reports of applicant’s treating psychologist Elena Konstat Ph.D., of December 15, 2014 and primary treating physician Fred Hekmat, M.D., of February 4, 2015 which were substantial evidence, and ordered that applicant was awarded “home care assistance by a psyche tech or LVN in order to prevent further institutionalization or suicide attempts.” Defendant appears to contend that the Dr. Konstat’s reports should be excluded from evidence because she is not a licensed physician and is not in its MPN; that Dr. Hekmat’s reports are not substantial evidence; that the WCJ failed to make a finding as to the date of receipt of a prescription for 1 Chairwoman Caplane and Deputy Commissioner Dietrich were on the panel that issued the Order and the Order Granting Reconsideration.
