This is our Opinion and Decision After Reconsideration. Defendant contends that the trial testimony does not support the findings of fact, that applicant self-inflicted his injury, and that it was error to exclude applicant’s wife’s testimony from trial because marital privilege was waived. We have not received an answer from applicant. The WCJ filed a Report and Recommendation on Petition for Reconsideration (Report) recommending that we deny reconsideration. We have considered the allegations of the Petition for Reconsideration and the contents of the WCI’s Report. Based on our review of the record and for the reasons stated below, as our Decision After Reconsideration we will rescind the Findings of Fact and return this matter to the trial level for further proceedings consistent with this opinion.FACTUAL BACKGROUND Applicant sustained significant injuries to multiple body parts as a result of falling from a four- story building on August 6, 2014.
