Thomason Mechanical Corp.; Aiu; Zurich North America; Ace/Usa Greg Turner WORKERS-COMPENSATION APPEALS BOARDSTATE OF CALIFORNIAGREG TURNER, Applicant,vs.THOMASON MECHANICAL CORP.; AIU; ZURICH NORTH AMERICA; ACE/USA, Defendant(s).Case No. ADJ638568 (AHM 0116132)OPINION AND ORDERS DENYING DEFENDANT’S PETITION FOR RECONSIDERATION AND DENYING APPLICANT’S PETITION FOR RECONSIDERATION Defendant, Zurich North America Insurance Company, and applicant, each seekreconsideration of the Amended Findings and Award, issued August 3, 2010, wherein the workers’ compensation administrative law judge (WCJ) found that applicant sustained a cumulative industrial injury’ to his “cervical and lumbar spine, hearing, upper and lower bilateral extremities’’ during the period from January 1, 1998 to February 17, 2003 while employed as a millwright. The WCJ also found that applicant’s industrial injury’ caused 84% permanent disability, payable at the rate of $230.00 per week in the total sum of $127,075.00 and thereafter a life pension of $92.77 per .week. Applicant was awarded further medical treatment “including possible psyche treatment.” The WCJ specifically found that “there is no evidence that the applicant was temporary disabled February- 17, 2005 to February 17, 2006” and denied applicant’s claim for temporary disability benefits during that period. Defendant contends that the WCJ erred by incorrectly calculating applicant’s permanent disability at 84% arguing that the correct calculation is 73% “with a resulting life pension of $50.25 per week.” Defendant further argues that substantial evidence supports a finding of 30% apportionment to non-industrial causes based upon the expert opinion evidence of Mark Brown, M.D , ln an unverified letter filed August 13, 2010, applicant contends that the WCJ erred by failing to find that applicant was temporarily disabled from February 17, 2005 to February’ 17, 2006, arguing that substantia] medic
