This is our Opinion and Decision After Reconsideration. Defendant filed two petitions seeking review of the WCJ’s decision to hear the trial in this matter via telephone conference. The first, a Petition for Reconsideration and/or Removal, sought review of the July 31, 2020 Minutes of Hearing denying defendant’s request for a continuance; the second, a Petition for Reconsideration, sought review of the subsequent August 26, 2020 Findings and Order (F&O) issued by the workers’ compensation administrative law judge (WCJ), wherein the WCJ found applicant sustained a compensable workers’ compensation injury to his back, and that he was not the initial aggressor in the sequence of events that led to his injury. Defendant contends that (1) the WCJ should have continued the matter to allow for in-person and/or video testimony rather than proceeding via telephone, and (2) the WCJ erred in finding applicant’s testimony credible and the testimony of defendant’s witnesses not credible. The Supplemental Petition also alleges errors in the Summary of Evidence, when compared to the trial transcript. We did not receive an Answer from applicant. The WCJ prepared a Report and Recommendation on Petition for Removal and/or Petition for Reconsideration, recommending that defendant’s first Petition be denied, and a Report and Recommendation on Petition for Reconsideration, recommending that defendant’s second Petition also be denied.
