Case No. ADJ7946701(San Jose District Office)ORDER DENYING RECONSIDERATION We have considered the allegations of the Petition for Reconsideration and the contents of the report of the workers’ compensation administrative law judge (WCJ) with respect thereto. Based on our review of the record, and for the reasons stated in said report which we adopt and incorporate, we will deny reconsideration. In denying reconsideration based on the WCJ’s Report, we did not consider the documents filed by applicant on January 15, 2013, because some of them violate WCAB Rule 10842, and because applicant filed them pursuant to WCAB Rule 10856 but he did not fully comply with the latter rule. (Cal. Code Regs., tit. 8, §§ 10842, 10856.) Furthermore, applicant’s cover letter indicates that it was copied to defense counsel, but there is no proof of service that the letter and all the documents were served on defense counsel. , For the foregoing reasons, IT IS ORDERED that said Petition for Reconsideration be, and it hereby is, DENIED.WORKERS’ COMPENSATION APPEALS BOARD________________________________________ALFONSO J.
