Case No. ADJ7507383 OPINION AND DECISION AFTER RECONSIDERATION On December 29, 2014, the Workers’ Compensation Appeals Board (Appeals Board) granted reconsideration of the October 9, 2014 Findingsand Award. This is our Decision After Reconsideration. In the October 9, 2014 Findings and Award, the Workers’ Compensation Administrative Law Judge (WCJ) found that applicant, while employedas a school bus driver on November 18, 2009, sustained an injury arising out of and in the course of her employment to her left knee, and, as a compensable consequence sustained injury arising out of and in the course of employment to her right knee, and did not sustain injury arising out of and in the course of employment to her psyche, or in the form of weight gain, sleep disorder, or sexual dysfunction. The WCJ found that applicant’s injuries caused 1 8% permanent partial disability and a need for medical treatment. Defendant contends that the WCJ erred in finding that applicant sustained injury arising out of and in the course of her employment to her right kneeas a compensable consequence of her left knee injury, arguing that applicant did not claim she sustained an injury to her right knee at either the mandatory settlement conference or the trial. Defendant also contends that the WCJ erred in finding that applicant sustained 18% permanent disability, arguing that the WCJ improperly relied on claimed wheelchair use.
