Defense petition for a finding that applicant has zero psychiatric permanent disability stands deferred. Defense petition seeking medical releases regarding psychological records of Dr. Barron is hereby denied. Defense petition to strike the February 13, 2009 report of Dr. Wilson is deferred. [Defendant’s] motion to take further cross-examination testimony of the applicant is denied.” In the Report and Recommendation on Petition for Reconsideration (Report), the WCJ noted: “The record shows that a Workers Compensation Judge appointed a neutral examiner in psychiatry and neurology. That physician, Dr. Steven Wilson, issued his first report on July 29, 2003 and was subsequently deposed on January 28, 2004. A second report from Dr. Wilson is dated October 11, 2006 and the doctor was deposed a second time on September 21, 2007. , On January 8, 2008, the parties appeared for trial before this Judge to address issues of further discovery including re-examination of applicant by the neutral medical examiner. This court granted defense Petition for the re-evaluation of applicant by Dr. Wilson. Dr. Wilson has now provided the court with an additional medical report dated February 13, 2009 and the court has received a transcript of Dr. Wilson most recent deposition take
