(CPC, now known as CPC Logistics) and Brigestone/Fircslone (B/F) and its workers’ compensation insurer on the date of injury, Insurance Company of the State of Pennsylvania (ICSP), seek reconsideration of the June 24, 2010 Findings and Award and Orders of the workers’ compensation administrative law judge (WCJ) who found that CPC was applicant’s geneial employer on October 1, 2001. the date he admittedly incurred industrial injury to his low back and right hip, and that B/F was applicant’s special employer on that date. CPC’s workers’ compensation insurer on the date of injury. Legion Insurance Company (Legion), is now in liquidation and defendant California Insurance Guarantee Association (CIGA) is responsible for its “covered claims” as proscribed by Insurance Code section 1063. l(cX9). Based upon the findings that applicant had dual employers on the date of injury, the WCJ entered the June 24, 2010 award against ICSP. He additionally ordered that CIGA was “relieved from further obligations to furnish claimant indemnity benefits herein and to administer said benefits,” and ICSP was appointed administrator of the claim. Petitioners contend that CPC was applicant’s sole employer on the date of injury and the , record does not support a finding of dual employment.
