INC.,STATE COMPENSATION INSURANCE FUND, Defendants.Case No. ADJ363747 (RDG 0125429)OPINION AND ORDER GRANTING RECONSIDERATION AND DECISION AFTER RECONSIDERATION Defendant seeks reconsideration of a workers’ compensation administrative law judge’s Findings and Award of July 15, 2009, wherein it was found that, while employed as a dishwasher/bus person on August 21, 2005, applicant sustained industrial injury to her right major elbow, right major upper extremity, right shoulder, and low back, but did not sustain industrial injury to her neck and right hip. The WCJ found that the applicant’s industrial injury caused temporary disability for the period February 22, 2006 to “the present and continuing.., subject to the 104 week [limitation] from the date of commencement of payment [pursuant to] Labor Code Section 4656(c)(1).” Defendant contends that the WCJ erred in finding that applicant’s industrial injury caused temporary disability. Defendant argues that the WCJ erred in making an implicit finding that applicant’s industrial injury caused complex regional pain syndrome (“CRPS”). Defendant argues that the WCJ should have followed the opinion of panel qualified medical evaluator, orthopedist I Robert Homer, M.D., who found that the applicant was permanent and stationary as of February 21, 2006, and had sustained 2% whole person impairment as a result of her injury, with no periods of temporary disability. We have not received an answer, and the WCJ has filed a Report and Recommendation on Petition for Reconsideration (“Report”). , As explained below, we will grant reconsideration, rescind the Findings and Award of July15, 2009, and return this matter to the trial level for the WCJ to issue a new decision consistent with Dr. Homer’s medical opinio
