Based on our review of the record, and for the reasons stated in said report which we adopt and incorporate, we will deny reconsideration. The petitioner, Innovative Medical Management, is admonished for filing a sloppy, unprofessional petition for reconsideration that does not comply with WCAB Rule 10845. Indentation of paragraphs is literally all over the place, there is a capitalized misspelling as if to emphasize its heedlessness, and these affronts are all topped off by a single-spaced second page, in flagrant violation of Court Administrator Rule 10232(a) (11). (Cal. Code Regs., tit. 8, §§ 10232, 10845.) Petitioner should be aware that such thoughtless inattention to the Rules of the Court Administrator is now subject to sanctions under WCAB Rule 10561.5. Code Regs., tit. 8, § 10561.5.)/ / // / // / // / // / / , For the foregoing reasons, IT IS ORDERED that said Petition for Reconsideration be, and it hereby is, DENIED.WORKERS’ COMPENSATION APPEALS BOARD_________________________________________RONNIE G. Biayna Bazquez vs. Apc Medical Group; State Compensation Insurance Fund
is a case in which Biayna Bazquez, the applicant, is appealing a decision made by the Workers' Compensation Appeals Board. The Board denied the petitioner's request for reconsideration, admonishing them for filing a sloppy, unprofessional petition that did not comply with the Court Administrator's Rules. The Board found that the lien of Tri County was correctly dismissed with prejudice due to the petitioner's failure to pay the lien activation fee prior to the commencement of the lien conference. The Board found that the petitioner provided no evidence that they were unable to pay the activation fee due to an EAMS error. The Board recommended that the Petition for Reconsideration be denied.
