Los Angeles Missionary Society; Fremont Compensation Insurance Company Bernard William Ponzi WORKERS-COMPENSATION APPEALS BOARDSTATE OF CALIFORNIABERNARD WILLIAM PONZI, Applicant,vs.LOS ANGELES MISSIONARY SOCIETY; FREMONT COMPENSATION INSURANCE COMPANY, Defendants.Case Nos. ADJ3393289 (LAO0594595)OPINION AND ORDERS GRANTING REQUEST TO FILE SUPPLEMENTAL PETITION AND DISMISSING PETITION FOR RECONSIDERATION By an untimely, unverified and skeletal petition. Bernard William Ponzi (applicant) apparently seeks reconsideration, possibly of the Findings and Award (F & A) issued in this case by a workers’ compensation administrative law judge on July 9, 1992 or a Lien Order, which issued on September 8, 1997. IJie petition for reconsideration does not set forth in full and specific detail the basis upon which the petitioner seeks reconsideration. The official WCAB case file is no longer available for our review. We note that applicant has filed a response to the report and recommendation on petition for reconsideration (report) filed by the Presiding Workers’ Compensation Administrative Law Judge (PWCJ). We will treat applicant s letter dated September 21, 2010 as a request to file a supplemental petition for reconsideration under Cal. Code of Regs, tit. 8, § 10848, ijnd grant the request. We have considered the allegations of the petition for reconsideration, the supplemental petition tiled by applicant, and the contenus of the report prepared by the PWCJ. Wc have not received an answer from defendant. Based upon our review of the record and for the reasons discussed below, we will dismiss applicant’s petition for reconsideration. , It is well settled ihai reconsideration may be had only of a final order, decision or award. (labor Code section 5900). In this case, no final order, decision or award has issued since the Lien Order of September 8. 1997. Therefore, it does not appear that applicant has been ‘’aggrieved.
Ponzi vs. Los Angeles Missionary Society & Fremont Insurance
(LAO0594595)The Los Angeles Missionary Society and Fremont Compensation Insurance Company were involved in a case before the Workers' Compensation Appeals Board in California. Bernard William Ponzi filed a petition for reconsideration, which was untimely, unverified, and skeletal. The Board granted the request to file a supplemental petition for reconsideration, but ultimately dismissed the petition for reconsideration due to the lack of a final order, decision, or award since the Lien Order of September 8, 1997. The Board recommended that Ponzi contact the court's Information and Assistance Officer to discuss his concerns and, if further proceedings before the WCAD are required, file a declaration of readiness to proceed.
