Arlinda Randle-Love vs. Kaiser Hospital, Kaiser Oakland

is a case in which Arlinda Randle-Love, an employee of Kaiser Hospital, Oakland, filed a workers' compensation claim for injuries sustained during her employment. The WCJ closed discovery and set the matter for trial on June 9, 2010. The Workers' Compensation Appeals Board granted the Petition for Removal, rescinded the order closing discovery and setting the matter for trial, and returned the matter to the trial level for the WCJ to convert the trial to a conference. This was done to assess the status of this and other cases and to determine the best approach to resolving all of them, considering both the interests of judicial economy and the interests of the parties.

Kaiser Hospital, Kaiser Oakland Arlinda Randle-Love WORKERS’ COMPENSATION APPEALS BOARDSTATE OF CALIFORNIAARLINDA RANDLE-LOVE, Applicant,vs.KAISER HOSPITAL, KAISER OAKLAND, Defendant(s).Case No. ADJ4266841 (OAK 0303570)OPINION AND ORDER GRANTING PETITION FOR REMOVAL AND DECISION AFTER REMOVAL            Applicant seeks removal with regard to the workers’ compensation administrative law judge’s (WCJ) March 4, 2010 order closing discovery and setting this matter for trial on June 9, 2010. This case arises from applicant’s claim that she sustained industrial injury to her neck, back, left shoulder, and upper extremity, while employed by Kaiser Hospital (Kaiser) as a supervisor/dispatch coordinator during the cumulative trauma period through October 16, 2003.            Applicant contends this matter is not ready for trial, arguing that not all parties are joined and only one date of injury is included, that applicant is not yet permanent and stationary, that further treatment is needed and has been denied by defendant, and that applicant will be prejudiced if this case is concluded before it is determined if any treatment or time off work is related only to this injury.            We have considered the Petition for Removal and defendant’s Answer, and we have reviewed the record in this matter. The WCJ prepared a Report and Recommendation of Judge Pro-Tem on Removal, recommending that the petition be denied.            For the reasons discussed below, we will grant the petition for removal, rescind the order closing discovery and setting the matter for trial, and return the matter to the trial level for the WCJ to convert the trial to a conference. ,             Applicant has filed at least four applications. Two separate applications were filed for a cumulative trauma through October 15, 2003, one for her employment at Kaiser (ADJ4266841, OAK 0303570) and the other for her concurrent employment at Alta Bates Medical Center (Alta Bates) (ADJ3701993, OAK 0327569).
