CITY OF PASADENA, Permissibly Self-Insured, ANDRE TEMURIAN, WORKERS’ COMPENSATION APPEALS BOARDSTATE OF CALIFORNIAANDRE TEMURIAN, Applicant,vs.CITY OF PASADENA, Permissibly Self- Insured, Defendant.Case No. ADJ362322 (VNO 0554826)OPINION AND ORDER GRANTING RECONSIDERATION AND DECISION AFTER RECONSIDERATION Applicant seeks reconsideration of the Findings and Award issued by a workers’ compensation administrative law judge (WCJ) on May 27, 2009, wherein the WCJ found that applicant did not sustain compensable industrial injuries to his psyche during a cumulative period ending on September 24, 2007, while employed by defendant as a senior code compliance officer. In the Opinion on Decision, the WCJ explained that applicant was required to show that actual events of employment were predominant as to all causes combined of the psychiatric injury, and that since none of the medical reports constituted substantial evidence, applicant had failed to meet his burden of proof. The WCJ ordered that applicant “take nothing” on his claim. Applicant contends that he sustained compensable industrial psychiatric injuries, arguing that his cumulative psychiatric injury was predominantly caused by actual events of employment, including the trauma of being harassed, intimidated, and yelled and screamed at by his immediate supervisor. Applicant argues that he presented substantial evidence of the harassment by way of medical reports -and testimony at trial. Applicant also contends the WCJ erred in finding that a dispute with the City of Pasadena over a remodel of his house was the predominant cause of his psyche injury, arguing that the WCJ improperly speculated that applicant was unduly stressed by the remodeling dispute. , We have considered the petition for reconsideration, and we have reviewed the record in this matter.
