Anait Kalandzhyan vs. L.A. Care Health Plan; State Compensation Insurance Fund; Zenith Insurance Company

is a case in which co-defendant State Compensation Insurance Fund (SCIF) sought reconsideration of a Stipulation and Order to Pay Lien Claimant(s) issued by a workers' compensation administrative law judge (WCJ). The Stipulation and Order provided that defendant was to pay lien claimant Normandy Pharmacy, Inc. the sum of $800.00 in full satisfaction of its lien. The WCJ recommended that the November 7, 2007 Stipulation and Order be set aside because it concerned resolution of a lien which had already been resolved prior to its issuance. The Workers' Compensation Appeals Board granted reconsideration and rescinded the November 7, 2007 Order.

The Stipulation and Order provided that defendant was to pay lien claimant Normandy Pharmacy. Inc. the sum of $800.00 in full satisfaction of its lien. Previously, on October 9. 2007. lien claimant agreed to accept the sum of $625.00. which defendant was ordered to pay. The underlying claims in this matter were resolved by way of Compromise and Release, approved on April 23, 2007, which provided that co-defendant SCIF was to adjust and pay or litigate the liens with the rights to contribution preserved for both co-defendant SCIF and co defendant Zenith Insurance Company.            1In its Petition for Reconsideration, co-defendant SCIF contends that the WCJ erred in issuing the November 7. 2007 Stipulation and Order as it ordered payment of $800.00 on a hen which had previously been resolved by the October 9. 2007 Stipulation and Order. Co-defendant SCIF also notes that payment was made pursuant to the October 9. 2007 order via a check dated , October 31. 2007. No Answer was filed.            In his Report and Recommendation on Petition for Reconsideration (“Repon”), the WCJ recommended that the November 7. 2007 Stipulation and Order be set aside because it concerns resolution of a lien which had already been resolved prior to its issuance.
