This is our Opinion and Decision After Reconsideration.            Applicant seeks reconsideration of the Findings, Award & Order (F&O) issued on May 4, 2016 by a workers’ compensation administrative law judge (WCJ). The WCJ found, in pertinent part, that applicant sustained’ injury arising out of and in the course of her employment (AOE/COE) as a nurse on August 3, 2012 to her neck and both upper extremities, and that defendant is entitled to a third-party credit in the amount of $184,54 7 .28 for compensation benefits due or that may become due1. The WCJ ordered that defendant is entitled to a third-party credit in the amount of $184,54 7 .28 for compensation benefits due or may become due.            Applicant contends that: 1) the WCJ determined that she failed to meet her burden of proof that Mission Hospital a9ted “professionally negligent” despite the parties agreement that the issue of Mission Hospital’s negligence would not be litigated at the March 8, 2016 trial; 2) that as a matter of law, the Medical Injury Compensation Reform Act of 1975 (MICRA) applies to applicant’s third-party action against Mission Hospital because her injuries, ” … were inextricably intertwined with activities 1 Applicant challenges only the WCJ’s Finding 10 and Order related to the third-party credit. , mandated as a result of Mission Hospital’s licensure as a health care provider
