ADJ1782471 (VNO 0381316)ADJ4122422 (VNO 0381607)OPINION AND DECISION AFTER RECONSIDERATION ANDORDER DISMISSING PETITION FOR REMOVAL We earlier granted the petition of lien claimant David Bresler, Ph.D., for reconsideration of the February 23, 2012 Findings And Orders of the workers’ compensation administrative law judge (WCJ), who found that Dr. Bresler “has not thus far cooperated in attempting to adjust the issue of costs and sanctions” with the Law Offices of Jeffery N. Sardell (Sardell), defendant’s former attorney, and ordered Dr. Bresler to pay Sardell “costs and expenses in the amount of $37,120” with interest, and to pay defendant Bameys New York and its adjuster Broadspire (Barneys/Broadspire) additional “costs and expenses in the amount of $3,141.58” with interest. Earlier, in a May 26, 2011 decision amended June 16, 2011 (May 26, 2011/June 16, 2011 decision), the WCJ found that Dr. Bresler engaged in bad faith actions and tactics causing Barneys/Broadspire to incur $10,713.84 in fees and costs, and causing Sardell to incur fees and costs “in an amount to be adjusted,” and ordered Dr. Bresler to pay Barneys/Broadspire, “$10,713.84 as reasonable Labor Code §5813 costs and expenses,” and to pay Sardell “reasonable Labor Code §5813 costs and expenses to be adjusted between the parties with jurisdiction reserved to the WCAB.” , It was previously found that applicant incurred industrial injury to various body parts while working for Barneys New York as a stocker on December 14, 1998 (ADJ1782471) and during the cumulative trauma period ending November 1, 1999 (ADJ4122422).
