In this case, Donna Smith was employed by Master Financial and sustained an admitted industrial injury to her upper extremities during a period through September 30, 2005. The Workers’ Compensation Appeals Board granted reconsideration of the Findings of Fact and Award of June 25, 2008, to further study the issues. The Board ultimately rescinded the Findings of Fact and Award and returned the matter to the trial level for further proceedings and a new decision that will include, at least, an express ruling (either as a finding of fact or an order) regarding defendant’s objection to the admissibility of Dr. Caputo’s May 31, 2007 report.
